Introduction
This Sales Policy outlines the terms and conditions governing the sale of goods and services by IT Playground (Pty) Ltd ("Seller") to its customers ("Buyers"). By placing an order with Seller, Buyer agrees to be bound by this Sales Policy.
Pricing
All prices are in the currency specified by Seller and are subject to change without notice. Unless otherwise agreed in writing, Buyer shall pay the price in full at the time of placing the order.
Orders
All orders are subject to acceptance by Seller. Seller reserves the right to refuse any order in its sole discretion. Once an order is accepted, it may not be cancelled or modified by Buyer except with the written consent of Seller.
Delivery
Delivery dates are estimated and not guaranteed. Seller shall not be liable for any loss or damage arising from any delay in delivery. Unless otherwise agreed in writing, all goods shall be delivered FOB (Free on Board) Seller's place of business, and Buyer shall be responsible for all transportation, insurance, and other costs and risks of loss or damage in transit unless otherwise agreed in writing.
Returns
Goods may be returned only with Seller's prior written consent and subject to its return policy in effect at the time. Buyer shall be responsible for all transportation, insurance, and other costs and risks of loss or damage in returning goods.
Warranty and Limitation of Liability
Seller warrants that goods/services will be free from defects in materials and workmanship for a period of 30 days from the date of delivery. Seller's liability for any breach of this warranty shall be limited to repair, replacement, or refund of the purchase price, at Seller's option. Seller shall not be liable for any other damages, including but not limited to incidental, consequential, or punitive damages.
Governing Law and Dispute Resolution
This Sales Policy shall be governed by and construed in accordance with the laws of South African law of sale. Any disputes arising out of or in connection with this Sales Policy shall be resolved by arbitration in accordance with the rules of AFSA.
Entire Agreement
This Sales Policy constitutes the entire agreement between Seller and Buyer with respect to the sale of goods and services by Seller to Buyer and supersedes all prior or contemporaneous communications and proposals, whether oral or written. This Sales Policy may not be amended or modified except in writing signed by bothparties.
By placing an order with Seller, Buyer agrees to be bound by this Sales Policy.
